View Article  Challenging the Breath Test (Part II)

Undetected, raw, unabsorbed alcohol in the mouth may falsely elevate the results of a breath test. This residual mouth alcohol (RMA) can come from items ingested just prior to the test, from regurgitated (burped) air from the stomach, or from gastroesophogeal reflux.  Ohio testing protocol attempts to guard against this testing flaw by requiring officers to observe the defendant for twenty minutes prior to the test.  They look for burping, vomiting or any ingestion of items into the mouth.  Lazy observation by the police officer can result in a contamination of the test.

The BAC DataMaster, Ohio's most common breath testing instrument, further guards against this type of problem with "slope detectors" wich look at the air coming into the machine.  If the air is too heavily laden with alcohol it changes the shape of the curve and should result in the machine kicking out an "INVALID SAMPLE" reading.  This reading requires the officer to start the observation period over again.  Good DUI attorneys know the science behind the "slope detector" and its operation and can effectively explain this to a jury.  Charles M. View Article  Challenging the Breath Test (Part I)

Ohio classifies DUI in two ways.  The first offense 4511.19(A)(1)(a) is the old fashion notion that you are "under the influence" of alcohol or drugs.  This definition is subject to expansion by the prosecution and is scrupulously narrowed by the defense.  Other portions of the statute deal with "per se" violations, known as breath test cases (blowing over the limit).  These two types of cases are very different and will be analyzed differently by competent DUI counsel. 

Ohio has judicially recognized rules and procedures to ensure the accuracy and reliability of the breath testing program.  These rules and procedures can be found in the Ohio Administrative Code.  Other "rules" that affect a breath test can come from departmental testing regulations, training procedures and operator's manuals.  Accordingly, an officer or department that ignores, skips or otherwise violates these administrative rules calls into question the accuracy and reliability of test results. 

Most jurisdictions will allow a test in unless the alleged deviations from the rules raise substantial and legitimate questions about the breath test that prejudices the defendant.  This is commonly referred to as the "substantial compliance test."  Good DUI counsel can effectively use these deficiencies to create reasonable doubt as to the test.  The weight given to the test is determined not by the court but by the jury.  God bless that wonderful check on judicial power.

But groups like Mothers Against Drunk Driving (MADD) argue that lowering the tax will harm underage drinkers because beer will become more affordable to youths who are especially sensitive to prices. MADD points out that young people consume approximately 10% of all beer sold, with more than 1.1 billion cans of beer consumed annually by underage drinkers.

"A lower tax could lead to more deaths among young underage drinkers," said Millie Webb, national president of MADD "The beer industry keeps pushing hard by saying how much the cost of beer is taxes but the fact is that a six pack of beer costs less than a six pack of soda in many parts of the country."

In fact, MADD supports a substantial increase in the taxes with the increased revenue to be used to fund alcohol abuse countermeasures, including enforcement and prosecution of impaired driving.

Experience teaches us that most police officers will testify that they did not form their opinion of probable cause until after they observed the very last intoxication fact and that it was then that they arrested your client. When this happens, leave it alone and don't ask anymore burden of proof questions. By doing so, you can argue in your closing that, even accepting all that the officer said was true, by his own words he only had probable cause, and, that is far short of the required proof beyond a reasonable doubt to convict.

LORETTO, Ky. - The bourbon company Maker's Mark is opening a new $2.5 million visitor center.

The Loretto distillery now gets 70,000 visitors each year for its free tours and it hopes to triple that number with the new center, according to The Courier-Journal of Louisville.

The Maker's Mark distillery is a National Historic Landmark, and the company was careful to protect the appearance when it expanded the tourism facilities. The new tasting lounge and gift shop, for example, are tucked inside a century-old rack house that holds about 1,000 barrels of aging bourbon.

Inside the rack house, sofas and bar stools are scattered across a sunken lounge that was patterned after the Maker's Mark bar at 4th Street Live in Louisville.

Other spirits companies also promote their brands with tours. Heaven Hill Distilleries runs the Bourbon Heritage Center in Bardstown, and Louisville's Brown-Forman Corp. promotes Woodford Reserve at its distillery in Versailles.

The opening of the new Maker's Mark facility coincides with the Sept. 11-16 Kentucky Bourbon Fest in Bardstown.

The newest technology in breath testing is the BAC DataMaste cdm.  This machine is able to print out the slope of the alcohol curve of the breath entering the machine.  In effect, this will demonstrate when a defendant tries to "trick" the machine by manipulating their breath.  It will also limit the defense of the test based on Residual Mouth Alcohol issues.  Don't get excited, however, they have not been purchased or used by any jurisdiction in Ohio...yet!

UPDATE:

I wanted to update this article! We are now beginning to see some jurisdictions using the new CDMs.  We await the decision of the Ohio Dept. of Health which may require all jurisdictions to switch to the new Intoxilyzer 8000.
