Discourage litigation. Persuade your neighbors to compromise whenever you can. Point out to them how the nominal winner is often a real loser in fees, expenses and waste of time. As a peace-maker the lawyer has a superior opportunity of being a good man. There will still be business enough...
There is a vague popular belief that lawyers are necessarily dishonest. I say vague, because when we consider to what extent confidence and honors are reposed in and conferred upon lawyers by the poeple, it appears improbably that their impression of dishonesty is very distinct and vivid. Yet the impression is common, almost universal. Let no young man chossing the law for a calling for a moment yield to the popular belief; resolve to be honest at all events; and if in your judgement you cannot be an honest lawyer, resolve to be honest without being a lawyer."

Prohibited Concentration

Driving with a prohibited concentration of alcohol in your blood breath or urine is a separate offense under Ohio law. If you have ever heard anyone refer to "blowing above a .08" they are referring to the most common test administered by law enforcement today, the breath test. Revised Code section 4511.19 sets forth the elements of Ohio’s tough DUI law (Note: The Ohio legislature has changed the universally understood “DUI” with the acronym “OVI). In Ohio, the legal limit for persons 21 and over is any of the following:
- .08 or more by weight of alcohol in blood;
- .08 of one gram or more by weight of alcohol per two hundred ten liters of breath;
- .11 of one gram or more by weight of alcohol per one hundred milliliters of urine;
- .17 of one per cent or more by weight of alcohol in the person’s blood:
- .17 of one gram or more by weight of alcohol per two hundred ten liters of the person’s breath:
- .238 of one gram or more by weight of alcohol per one hundred milliliters of the person’s urine.
The .17 threshold is used to enhance the penalties for “higher test” offenders, doubling the jail time at each tier of the sentencing.

The Fourth Amendment

I just wanted to memorialize what the Fourth Amendment to the United States Constitution said. It was written by radical beer-swilling activists who did not want the government stopping your car (horse?) to see if your papers were in order .
"The right of the people to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched and the persons or things to be seized."

At least until September, I am the only Ohio attorney certified on the Intoxilyzer 8000. Couple this with the fact that my National Patent training included the new DataMaster CDM, and I am fairly confident in my ability to understand your breath test.

HOW DO I CHOOSE AN ATTORNEY?

Choose a lawyer who is knowledgeable and competent in the field of criminal law and has taken steps to further his or her education in the field. Remember, you are the consumer and you should receive a good service for your dollar. Choose an attorney who will take the case to trial if necessary. Find out what his or her experience has been with the court in question and find out if he or she feels that they can competently represent you. Find out what the attorney's retainer fee is and find out what the attorney's hourly rate is. For many people contact with the court system will be one of the most traumatic and life-altering events they will experience. Hire a competent attorney who will not be afraid to challenge the government and fight for your rights!

I wish to express my gratitude to the Beavercreek Chamber of Commerce for recognizing us (the Beavercreek School Board) with its PUBLIC EDUCATION AWARD. It does, and always will, mean a lot to me because it recognizes the committment that we have made to Beavercreek and to the school system. The recognition from the Ohio Senate (Steve Austria) and from the Ohio House of Representatives (Kevin Dewine) has a special meaning given their committment to making our community better.
