After a sucessful defesne of a DUI my client asks, so what is the definition of Reckless Operation?  I respond with the following:

Ohio Revised Code section 4511.20 Operation in willful or wanton disregard of the safety of persons or property.

(A) No person shall operate a vehicle, trackless trolley, or streetcar on any street or highway in willful or wanton disregard of the safety of persons or property.

(B) Except as otherwise provided in this division, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.


The client accepts the reduction and all are satisfied.

I am often asked what a DUI conviction will cost.  While no similar numbers are available for Ohio, this California example is compelling.  In 2004, Research for the Automobile Club of Southern California stated that a motorist convicted of a first-time DUI offense in California currently faces a total cost of $12,116. The cost includes minimum fines, $468; penalties, $780; vehicle towing and impound, $187; alcohol education class, $500; increase in auto insurance, $7,300; victim restitution fund, $100; DMV license reissue fee, $125; booking, fingerprinting and photo fee, $156, and attorney and legal fees, $2,500.

What should you say if you are pulled over for suspicion of drunk driving?

You are not required to answer potentially incriminating questions. A polite "I would like to speak with an attorney before I answer any questions" is a good reply. On the other hand, saying that you had one or two beers is not incriminating: it is not sufficient to cause intoxication -- and it may explain the odor of alcohol on the breath. Remember, the officer is looking for information to use against you in court.

ROWLAND AWARED BREATH TESTING CERTIFICATE

To be a good attorney you have to continue to study hard.  Charles M. Rowland II has done just that.  With a practice devoted largely to defending the accused drunk driver, Rowland felt the need to be certified on the breath test machine that often serves as the State's best evidence.

Rowland attended training at the headquarters of National Patent Analytic Systems, the maker of the BAC Datamaster, the Datamaster CDM and the newly minted DMT breath testing device.  He is now ready to take his newly acquired knowledge into the courtroom. "Last year I purchased the BAC Datamaster and found it to be very beneficial in my knowledge of the State's evidence.  I wanted to become certified on the machine so that I could provide the best defense possible to my clients." 

The three-day training seminar centered on the scientific principles of breath testing, infrared spectrophotometry, the chemical properties of ethanol absorption and elimination and the mechanical components of the instruments. "It was very intense.  We tore those things open and learned every scientific principle relative to the modern day process of evidential breath testing," said Rowland.

When asked why the manufacturer would allow defense attorneys to learn about the machine, Rowland cites the integrity, honesty and passion of John Fusco, CEO of NAPS and one of the driving forces behind breath testing. "He is dedicated to the process and really believes in the science behind his product.  He believes in the justice system and understands my role in defending my client." 

View Article  Teenage Drinking Continues to Drop

Contrary to common belief, the consumption of alcohol continues to decline among young people across the United States and fewer are drinking and driving. “Bad as it may seem, it’s not nearly so big a problem as everyone thinks it is,” reports Dr. Robert Foss, senior research scientist at the Highway Research Safety Center at the University of North Carolina at Chapel Hill. “ And it’s much less a problem than it was 20 years ago.,” he emphasizes.

Dr. Foss says that when people are asked how much underage drinking is going on, “they almost always way overshoot the reality.” Correcting the common misperception that a lot of people drink and drive has proven successful in reducing actual drinking and driving in the state of Montana. The technique is called the social norms marketing approach and it is widely used to reduce drinking problems.

Although alcohol abuse among young people continues to drop, it’s still much too high . We need to continue the use of successful approaches such as social norms marketing.

The Law Office of Charles M. Rowland II is an established litigation practice handling state and federal cases in the Miami Valley and throughout Ohio. Charles Rowland has been a trial lawyer in Greene County since the inception of his practice. He is a 1988 graduate of Beavercreek High School and a life-long resident of Beavercreek, Ohio. He graduated magna cum laude from Wright State University in 1992, earning a Bachelor of Arts degree in Political Science and a minor in Sociology with a concentration in Criminology. Charles earned the degree of University Honors Scholar with Honors in Political Science, received an Academic Letter Award, was awarded Phi Kappa Phi honors and was selected to represent Wright State University as a Student Ambassador to the People's Republic of China.

He was awarded the H. E. Ashcroft Memorial Scholarship to attend Ohio Northern University's Pettit College of Law. While in law school, Charles studied as a visiting scholar at the University College London, Bentham Faculty of Laws and served as an Associate Justice on the Ohio Northern University Moot Court Program. He received his law degree in 1995, graduating in the top 25% of his class and was named to the prestigious Order of the Barristers for excellence in appellate advocacy. Following law school, he returned to Greene County and the Dayton area to practice in his home town.

Charles Rowland has appeared as an expert on television, radio and in newspapers. He has been included in the 2005-2006 edition of the National Register of Who’s Who in Executive and Professionals and was the 2004 Foundation Recipient of the District 6, Community Service Award for Attorneys under 40. In 2005, Charles Rowland was given the singular honor of being named a Fellow of the Ohio State Bar Foundation. Charles Rowland maintains memberships in the Greene County Bar Association, the Ohio State Bar Association, the Association of Trial Lawyers of America, the National Motorists Association, the National Association of Personal Injury Lawyers, the Ohio Academy of Criminal Defense Lawyers, the National College for DUI Defense in Cambridge, Massachusetts and is a member of DUI Defenders, a nationwide network of DUI attorneys. Mr. Rowland currently serves as Vice-President for the Greene County Bar Association.

In November 2005, Charles was re-elected to serve a four-year term on the Beavercreek Board of Education. He is co-founder and past-president of the Beavercreek High School Alumni Association, Treasurer of the Wright State Honors Advisory Counsel, advisor to the Board of Directors of the Beavercreek Wetlands Association, and served on the St. Luke Parish Council where he has volunteered as a School of religion teacher. He currently serves on the Board of Directors of The Community Network (TCN-BHS), Greene County's Mental Health provider and on the Legislative Committee of the Beavercreek Chamber of Commerce.

Charles M. Rowland II has been a trial attorney since beginning his practice in 1995. He has served as a Special Prosecutor for Greene County, the Xenia City Prosecutor, as counsel for the Greene County Public Defender's Office and has helped indigent clients in consumer related cases with Southeastern Ohio Legal Aid Services. He represents traffic clients throughout Ohio on behalf of Interstate Trucker Ltd. and the National Motorists Association.
